The grounds for legal separation in New York include:

  • Imprisonment for three or more consecutive years

If both spouses were not New York residents when the grounds for divorce arose and the separation filed for, the couple will have to meet a residency time limit requirement. If only one spouse is a resident of New York at the time of filing for legal separation, the residency requirement is two years.

The requirement is reduced to one year if:

  • The spouses were married in New York and either spouse is still a resident
