On June 24, 2011, New York State passed The Marriage Equality Act, making it legal for same-sex couples to get married for the first time in the state's history. Although same sex-marriage in New York is a relatively new right, the divorce process for separating spouses, regardless of sexual orientation, remains the same.

Requirements to Divorce

To obtain a divorce in New York, you or your spouse must have lived in New York continuously for one year. Because New York is known as "no-fault" divorce state, spouses are permitted to divorce on the ground of irretrievable breakdown. Irretrievable breakdown simply means that the marriage won’t work any longer for whatever reason. As such, there is no requirement that you place fault or blame on your spouse for the failure of the marriage. Additionally, a final judgment of divorce will require resolution of other pertinent issues, including:

  • Child Custody
  • Visitation rights
  • Child Support
  • Debt Division
  • Property Division
  • Spousal Maintenance

The Law Office of Robert H. Montefusco, P.C. is well versed in the nuances, complexities and the developing trends and changes of New York divorce law.
