Recently, Mr. Montefusco was able to secure an acquittal for his client who was charged with Driving While Intoxicated (by observation).  Mr. Montefusco’s client was signaled out during a road side sobriety check point.  After the District Attorney refused to plea down the charge, Mr. Montefusco prepared his case for trial. 

The matter encompassed three stages and at each stage Mr. Montefusco engaged in aggressive cross examination of the police officer which resulted in the successful outcome.  The first stage was the Department of Motor Vehicles refusal hearing.  The second stage was pre-trial hearings in criminal court regarding statements that the client made to the police officer and probable cause for the arrest.  The final stage was a jury trial.

At the conclusion of the trial, the jury returned a verdict of not guilty to all counts, including a lesser charge of Driving While Ability Impaired. 

Afterward, Mr. Montefusco spoke with some members of the jury and they were so        impressed with his cross-examination of the police officer that they said they did not  find the police officer credible.
